CONDICIONES DE
VENTA
La Casa de las Américas, en colaboración
con la Fundación Ludwig de Cuba, realizará una subasta de
arte contemporáneo cubano a beneficio del Servicio de Oncohematologia
del Hospital Pediátrico José Luis Miranda, de Villa Clara.La
subasta tendrá lugar durante la celebración de la VIII Bienal
de La Habana, el día 2 de noviembre del 2003. Obras de cuarenta
y nueve artistas cubanos han sido donadas y autentificadas por sus autores
para este fin humanitario.
Las siguientes Condiciones de Venta y Términos de Garantía
constituyen el acuerdo que la Casa de las Américas y el Consignador
(artistas y propietarios) celebran con el Comprador respecto de las piezas
listadas en este catálogo. Las Condiciones de Venta, los Términos
de Garantía y todo el contenido de este catálogo están
sujetos a modificaciones a través de notificaciones o anuncios
orales a realizarse durante la subasta. Ofreceremos las piezas en nuestra
calidad de agentes del Consignador, a menos que el catálogo indique
lo contrario.
1. La autenticidad de la Autoría de la propiedad mencionada
en el catálogo está garantizada por certificados emitidos
y firmados por los Consignadores. Toda pieza es vendida en el estado en
que se encuentra sin ningún tipo de declaración ni garantía
de nuestra parte o del Consignador. Ni el Consignador ni nosotros emitimos
declaración o garantía, expresa o implícita, con
respecto a la adquisición por parte del Comprador, de algún
derecho de propiedad intelectual, incluidos, entre otros, derechos de
reproducción sobre cualquier pieza. El Consignador y nosotros no
somos responsables por errores y omisiones del catálogo o cualquier
material complementario.
2. Los eventuales oferentes deberán inspeccionar las piezas
antes de presentar sus ofertas a fin de determinar su condición,
tamaño y constatar si las mismas han sido reparadas o restauradas.
3. Se añadirá una prima del 5% de la oferta vencedora
la cual será pagada por el comprador como parte del precio total
de compra.
4. Nos reservamos el derecho de retirar cualquier pieza antes de la venta,
sin asumir por ello responsabilidad alguna.
5. A menos que el rematador anuncie lo contrario, todas las ofertas
habrán de realizarse por lotes según la numeración
indicada en el catálogo.
6. Nos reservamos el derecho de rechazar cualquier oferta. El mejor
oferente reconocido por el rematador será considerado el comprador.
Queda a discreción del rematador el establecer qué oferente
ha sido el vencedor. Si surge alguna disputa después de la venta,
nuestro registro de venta será irrebatible.
7. Si el rematador decide que una oferta de apertura es inferior
a la reserva del artículo ofrecido, podrá rechazarla y retirar
el artículo de la venta, y si, habiendo conocido la oferta inicial,
decide que cualquier avance de ahí en adelante es insuficiente,
puede rechazar el avance.
8. Sujeto al cumplimiento de todas las condiciones estipuladas
en el presente, al bajarse el martillo del rematador, el título
del lote ofrecido pasará a pertenecer al mejor oferente reconocido
por el rematador. Dicho oferente de ahí en adelante:
(a) asume total riesgo y responsabilidad por el mismo
(b) pagará inmediatamente el precio total de compra.
El pago no será considerado completo hasta que no hayamos cobrado
fondos válidos.
Si el mejor oferente reconocido no se presenta en la oficina de pago durante
el día 3 del mes de noviembre 2003 la Casa de las Américas
se reserva la decisión de venderle la obra al anterior oferente
que aparece en los registros oficiales de la Subasta de dicho lote.
El comprador deberá retirar de nuestro local toda pieza, por su
propia cuenta y cargo, antes de transcurridos cinco días hábiles
desde la venta y, en caso de no hacerlo,
(i) la Casa de las Américas no se responsabiliza con el
envío de la propiedad adquirida y
(ii) la pieza pasará a los fondos de la Casa de las Américas.
9. La Casa de las Américas entregará al Comprador
una factura donde se consigne la descripción de la pieza, el monto
pagado por ella, y los fines humanitarios a que estarán destinados.
10. La Casa de las Américas ofrece facilidades de embalaje
y manipulación de los lotes comprados hasta el momento de la entrega
al Comprador, si éste así lo solicita.
11. En ningún caso nuestra responsabilidad hacia un Comprador
excederá el precio de compra efectivamente pagado.
12. En los aspectos financieros la Casa de las Américas,
, ratifica que el pago podrá realizarse:
(a) En efectivo
(b) Cheques de viajero, todo tipo de cheques en USD o CUC emitidos
por bancos cubanos a favor de casa de las Américas
(c) Tarjetas de créditos válidas en los bancos cubanos
(TRAN$CARD, MASTERCARD,VISA, CABAL)
(d) Otras formas de pago a través de bancos norteamericanos
para los que la empresa TRAN$CARD- AMIGO TRAVEL CARD ofrece el servicio
de emisión de tarjetas de débito AMIGO TRAN$CARD que serán
válidas en cualquier transacción por compra de bienes o

Para este propósito la Casa de las Américas habilitará
una oficina en su sede donde se efectuarán los pagos por una de
las vías antes mencionadas, y se autorizará la entrega de
la pieza, una vez efectuada la transacción monetaria.
TERMINOS DE GARANTIA
La Casa de las Américas ofrece garantía de la autenticidad
de la autoría de cada lote descrito en el catálogo, además
de otras establecidas según los términos y condiciones que
se describen más abajo.
1. Definición de Autoría. Se entenderá por
"Autoría" el Certificado de autenticidad entregado por
el autor de la pieza el día de su donación, con los datos
técnicos de la misma y la firma original del autor. Asimismo, se
considera válido, el Certificado de autenticidad entregado por
los propietarios de la obra de artistas ya fallecidos. La Casa de las
Américas no otorga ningún tipo de garantía, expresa
o implícita, con respecto a cualquier material en este catálogo,
salvo lo que aparezca en el Certificado de autenticidad.
2. Garantía de embalaje. La Casa de las Américas
facilitará embalajes ligeros para garantizar la integridad de la
obra en el momento de su entrega y transportación.
3. Garantía de exportación. En correspondencia con
la Ley vigente del Registro Nacional de Bienes Culturales, la Casa de
las Américas ha tramitado los permisos de exportación definitiva
de los lotes vendidos, lo cual garantiza la legalidad del traslado de
la obra fuera del territorio nacional.
4. Intransferibilidad. Los beneficios de esta garantía no
podrán ser cedidos y serán únicamente aplicables
al comprador original que figure en nuestros registros.
Para su conveniencia, la Casa de las Américas ha realizado una
traducción al inglés de nuestras Condiciones de Venta y
Términos de Garantía. No obstante la versión en español
de las Condiciones de Venta y Términos de Garantía será
única aplicable y obligatoria para toda compra realizada en esta
subasta.
CONDITIONS OF SALE
Casa de las Americas, in collaboration
with the Ludwig Foundation of Cuba will organize a Charity Auction of
Contemporary Cuban Art benefiting the Pediatric Oncohematology Hospital
José Luis Miranda of Villa Clara. The Auction will take place during
the celebration of the VIII Havana Biennial on the 2 November 2003. Works
from forty-nine Cuban artists have been donated and authenticated by the
authors for this humanitarian end.
The following Conditions of Sale and Terms
of Guarantee constitute the agreement between Casa de las Americas and
the Consignor (artists and owners) celebrated with the buyer in respect
to the works listed in this catalogue. The Conditions of Sales, Terms
of Guarantee, the glossary and all other contents of this catalogue are
subject to amendment by us by posting of notices or by oral announcements
made during the sale. The property will be offered by us as agent for
the Consignor, unless the catalogue indicates otherwise.
1- The authenticity of the Authorship of property listed in the
catalogue is guaranteed by certificates handed over by and signed by the
Consignor. All property is sold "AS IS" without any representations
or warranties by us or the Consignor. We and the Consignor make no representations
and warranties, express and or implied, as to whether the purchaser acquires
any copyrights, including but not limited to, any reproduction rights
in any property. We and the Consignor are not responsible for errors and
omissions in the catalogue, glossary, or any supplemental material.
2- Prospective bidders should inspect the property before bidding
to determine its condition, size and whether or not it has been repaired
or restored.
3- A buyer's premium will be added to the successful bid price
and is payable by the purchaser as part of the total purchase price. The
buyer's premium is 5% of the successful bid price.
4- We reserve the right to withdraw any property before the sale
and shall have no liability whatsoever for such withdrawal.
5- Unless otherwise announced by the auctioneer, all bids are per
lot as numbered in the catalogue.
6- We reserve the right to reject any bid. The highest bidder acknowledged
by the auctioneer will be the purchaser. The auctioneer will have final
discretion to determine the successful bidder. If any dispute arises after
the sale, our sale record is conclusive.
7- If the auctioneer decides that any opening bid is below the
reserve of the article offered, he may reject the same and withdraw the
article from sale, and if, having acknowledged an opening bid, he decides
that any advance thereafter is insufficient, he may reject the advance.
8- Subject to the fulfillment of all of the conditions set forth
herein, on the fall of the auctioneer's hammer, title to the offered lot
will pass to the highest bidder acknowledged by the auctioneer, and such
bidder thereupon:
(a) assumes full risk and responsibility therefore
(b) will immediately pay the full purchase price or such part as
we may require.
Payment will not be considered complete until we have received valid funds.
In addition, if the highest bidder acknowledged by the auctioneer has
not fulfilled payment in full during office hours of November 3, 2003
Casa de las Américas reserves the right to offer the art to the
second highest bidder of that lot noted on the official register of the
Auction.
All property must be removed from our premises by the purchaser at his
expense not later than five business days following it's sale and, if
it is not so removed,
(i) Casa de las Américas will not be responsible for the
transport of the purchased property and,
(ii) the purchased property will be transferred as property of
Casa de las Américas.
9- Casa de las Américas will hand over to the Buyer an invoice
containing full description of the property, full amount paid and the
humanitarian cause to which payment is destined.
10- Casa de las Américas offers packing and handling facilities
up to the moment of final handover to the Buyer if so desired.
11- In no event will our liability to a purchaser exceed the purchase
price actually paid.
12 - In financial aspects Casa de las Americas ratifies that payment
may be done:
a) In cash
b) Travelers checks, all types in US Dollars or CUC emitted by
Cuban banks in favor of Casa de las Americas
c) Credit cards valid in Cuban banks (Tran$card, Mastercard, Visa,
Cabal)
d) Other forms of payment through North American banks for those
who the company TRAN$CARD-AMIGO TRAVEL CARD offers the service of debit
card emission AMIGO TRAN$CARD that will be valid for any transaction of

For these purposes Casa de las Americas will enable an office in the main
building where these payments will be effectively done, by anyone of the
above mentioned transactions and the hand over of the piece will be authorized
once the transaction has been completed.
TERMS OF GUARANTEE
Casa de las Américas warrants the authenticity of Authorship of
each lot contained in this catalogue on the terms and conditions set forth
below.
1- Definition of Authorship. "Authorship" is defined
as the Certificate of Authenticity handed in by the author on the day
of the donation, containing the technical data and signed by the author.
Equally valid will be the Certificate of Authenticity handed in by the
owners of property by deceased artists. Casa de las Américas will
not warrant any other form of guarantee, implicit or explicit, in relation
to any material in this catalogue, unless included in the Certificate
of Authenticity.
2- Packing Guarantee. Casa de las Américas will facilitate
light packing to guarantee the integrity of the property at the moment
of purchase and transportation.
3- Export Guarantee. In correspondence with the current law under
the National Register of Cultural Patrimony, Casa de las Américas
has acquired the proper definitive export permits of the sold lots, thus
guaranteeing the legality of the export of the property outside of the
country.
4- Transport and insurance. Buyers will be given the option of
making use of cargo and international transportation services established
internationally.
5- Non-Transferable. The benefits of this guarantee cannot be transferred
and are solely applicable to the original buyer noted in our register.
For your convenience Casa de las Americas has provided a translation into
English of our Sales Conditions and Terms of Guarantee, this notwithstanding,
the Spanish version of the Conditions of Sale and the Terms of Guarantee
will be the only applicable, binding and obligatory for all purchases
during this Auction.
SOLUCION DE PAGO
Las personas que deseen hacer sus pagos a través de bancos norteamericanos,
pueden adquirir la tarjeta Transcard-Amigo Travel Card antes de viajar.
Amigo Travel Card es una tarjeta de débito prepagada que se acepta
en toda la red de establecimientos en Cuba para pagar productos o servicios,
al igual que para retirar dinero en efectivo. La misma podrá ser
utilizada para el pago de las obras de la Subasta Humanitaria que se efectuará
el 2 de noviembre en la Casa de las Américas.
Para adquirir la tarjeta es necesario abrir una cuenta Amigo-Transcard
en la página de Internet www. amigotravelcard.com. Con ese número
de cuenta, puede efectuar la transferencia bancaria por la cantidad que
usted desee depositar en su tarjeta. Si el valor es hasta $2000.00 dólares
el costo de la tarjeta es $20.00. Si es mayor , debe pagar el 1% de la

Attendees wishing to pay through an American bank may now do so by
obtaining the card Transcard- Amigo Travel Card before traveling.
Amigo Travel Card is a prepaid debit card accepted as form of payment
all over Cuba as well as cash withdrawals at any bank or currency exchange
outlet(CADECA).
This Card will be accepted as form of payment of the art pieces to be
sold during the charity auction taking place November 2nd at Casa de las
Americas.
In order to obtain this card, you must open an Amigo account by visiting

to send a wire transfer for the amount you wish to deposit in your card.
The cost of the card is $20.00 for cards up to $2000.00. Should the deposit
